Accreditation

Accreditation Applications to the Bar under the Australian National Mediator Standards

1. Barristers accredited under the 2006 Victorian Bar Scheme (or another recognised scheme) may be able to be accredited under the National System as “experience qualified” without taking any additional training course. Please complete and lodge with the Bar Office the experience qualified form.

2. For experience qualified accreditation, barristers must have:

a) read and understood the:

b) worked as a mediator prior to 1 January 2008; and

c) have current accreditation as a mediator with the Victorian Bar (all barristers accredited by the Bar, however long ago accredited, are accredited under the 2006 Victorian Bar Scheme until 30 June 2009); or, if not currently accredited with the Victorian Bar, specify mediation course(s) taken and any other accreditations, such as IAMA, LEADR, etc.; give the date of each such accreditation; and whether it is still current; and

d) been in full-time legal practice (not necessarily all at the Bar) for at least five years; and

e) conducted at least 25 hours of mediation, co-mediation or conciliation in the 2 years immediately prior to your application, OR 10 hours in special circumstances:-

  • “Mediation, co-mediation or conciliation” extends beyond conducting mediation, but does not include acting as counsel for a party to mediation – one must have the carriage of the “mediation, co-mediation or conciliation”.
  • For the special circumstances reduction, please check the applicable designated circumstances, and please note that the category “other” requires specification; and

f) completed at least 20 hours of CPD / CLE as defined in footnote (iii) of the “experience qualified” application form.

  • This includes up to 8 hours as counsel to a party in mediation and up to 10 hours coaching, instructing or mentoring less experience mediators.

The 2006 Victorian Bar Scheme

1. As previously advised, the last day for applications under the 2006 Victorian Bar Scheme was 30 April 2008.

2. No re-accreditation under the 2006 Victorian Bar Scheme is necessary or appropriate.

3. The 2006 Victorian Bar Scheme did require biennial re-accreditation that was to have commenced on 1 April 2008. However, that requirement was overtaken by the event that, before then, on 1 February 2008, the Bar committed itself to the Australian National Mediator Accreditation System and became a Recognised Mediator Accreditation Body.

4. As part of the transition to the National System, all accreditations as a mediator or advanced mediator under the 2006 Victorian Bar Scheme now continue in force until 30 June 2008, without the need for any re-accreditation under that Scheme.

 

Advanced Mediator Accreditation

1. The Bar Council has now established a category of Advanced Mediator accreditation by the Bar consistent with the National Mediator Accreditation System.

2. Advanced Mediator accreditations under the 2006 Victoria Bar Scheme continued in force until 30 June 2008. As of 1 July 2008, all barristers who have been accredited as Advanced Mediators under the 2006 Victorian Bar Scheme who are also currently accredited by the Bar as Mediators under the National Mediator Accreditation System remain accredited by the Victorian Bar as Advanced Mediators under the new Victorian Bar Advanced Mediator Scheme – paragraph 1 immediately above without need of any application on the part of the barrister.

3. Barristers accredited by the Victorian Bar under the National System as Mediators may apply to be accredited as Advanced Mediators by completing and lodging the Advanced Mediator Application form at the Bar Office.

4. Advanced Mediator Accreditation under the 2006 Victorian Bar Scheme in relation to barristers who have not been accredited by the Bar under the National System lapsed on 1 July 2008.

 

CPD Seminar 17 March 2008

The Bar Dispute Resolution Committee conducted a CPD seminar on 17 March 2008 to explain the Bar’s transition into the Australian National Mediator Standards System and accreditations by the Bar as a recognised mediator accreditation body in that system.

The handouts from that session supplement the National System Approval Standards and the National System Practice Standards.
